The mission of the City of Wheaton Code Enforcement Department is to help maintain the health, safety, and welfare of our community. Property Maintenance Topics

Permits Required for Construction

Permits are required for any construction or remodeling work involving structural, electrical, mechanical, plumbing, or roofing. There are also permits required for replacing windows, installing solar panels, and other miscellaneous home improvement projects. Tall Grass and Weeds

Keeping your yard well-maintained makes the neighborhood more attractive. By cutting your grass regularly and controlling weed growth on your property, you will be helping to keep Wheaton a beautiful place to live and work. The City requires you to keep your grass height below 8 inches. Additionally, any weeds within the grass also need to be maintained below 8 inches. Planting beds must be periodically maintained and weeds growing in excess of 8 inches in these areas need to be removed. Outdoor Storage

Yards are not to be used as storage areas. Items such as car parts and tires, building supplies, indoor furniture, and/or appliances may not be stored within the view of the public, or neighbors. Limiting outdoor storage enhances the appearance of neighborhoods. Excessive outdoor storage is prohibited in all zoning districts unless specifically permitted by the zoning district.

Garbage at the Curb

The City of Wheaton does have some rules for putting your garbage at the curb for your weekly pickup. The ordinance allows for garbage cans to go out after 6 p.m. the night before the scheduled pickup day. Cans and all items not collected for disposal must be removed from the curb by 7 p.m. on the day of the scheduled collection day. Please do not put out furniture, metal, yard waste, or any other items intended for haul-away before the day of your scheduled pickup. Sometimes, items are not taken by the haul-away company. The homeowner is responsible for retrieving any uncollected items from the curb and calling the haul-away service for proper disposal instructions. Our current contractor for garbage pickup is LRS. Accumulation of Trash/Rubbish

The accumulation of rubbish on your property is prohibited. Items such as paper, rags, cartons, boxes, wood, tree branches, yard trimmings, tin cans, metals, glass, and/or other similar waste that results from the operation of a household must be disposed of properly within an appropriate container. Items such as old clothing, discarded toys or furniture, etc. cannot be stored in the open on your property. All rubbish must be contained as it is unlawful for anyone to deposit rubbish anywhere in the City or within an open container that allows for it to be blown about by the wind.

Maintenance of Accessory Structures

Any structure you have on your property must be well-maintained and structurally sound. Structures such as fences, storage sheds, garbage screens, detached garages, play equipment, etc. must be kept well-maintained and in working order. Items that fall into disrepair have a negative effect on your neighborhood, so please keep your property maintained.

Vacant Structures

The City requires all vacant properties to be kept to the minimum standards as outlined in the City of Wheaton Zoning Ordinance and the current adopted version of the International Property Maintenance codes. Vacant properties that are not properly maintained are a detriment to the City and will not be allowed to fall into disrepair. Sidewalk Obstructions

One of the City's priorities is making our community's neighborhoods pedestrian-friendly for all residents and visitors. Sometimes, bushes, weeds, grass, and trees can overhang the sidewalk, making sidewalks difficult to traverse. Please ensure all bushes, mulch, shrubs, and other vegetative growth are cut back so the whole sidewalk can be used when walking side-by-side, pushing a stroller, or using a wheelchair. Also, please trim away branches from trees or other greenery so there are no obstructions for people walking on the sidewalk.

Tenant / Landlord Disputes

If you are a tenant in dispute with your landlord, the City will not get involved. All of these disputes are civil matters, which must be handled through the DuPage County Court system. If you are a tenant with property maintenance concerns, the City will require you to work with your landlord first by bringing to their attention, whatever your concerns are. It is in your best interest to communicate with your landlord in writing; email is the preferred method. If your landlord fails to address your concern, the City will request a copy of your correspondence with your landlord before we initiate a case. Once we review the correspondence, we will determine if enforcement can be implemented.
